Hate Crimes and The Mitchell v. Wisconsin Decision Essay -- Hate Crime
Hate Crimes and The Mitchell v. Wisconsin Decision The American Heritage Dictionary defines hate as intense dislike or animosity. However, defining hate as the basis for a crime is not as easy without possibly jeopardizing constitutional rights in the process. Hate crime laws generally add enhanced punishments to existing statues. A hate crime law seeks to treat a crime, if it can be demonstrated that the offense was a hate crime differently from the way it would be treated under ordinary criminal law. Since the 1980s, the problem of hate crimes has attracted increasing research attention, especially from criminologists and law enforcement personnel who have focused primarily on documenting the prevalence of the problem and formulation criminal justice responses to it. Lawmakers have passed legislation to encourage data collection and attach enhanced penalties to hate crimes at both state and federal levels. à à à à à When Americans are assaulted merely because of their real or perceived sexual orientation, gender, or disability, the law should be as tough on their assailants as it currently is tough on criminals who attack based on racial, religious, or ethnic bias. Yet only in rare circumstances can the federal government investigate and prosecute hate violence against gays, lesbians, or bisexuals. Attempts have been made to reach a definition of hate crime, including that it is a crime, most commonly violence, motivated by prejudice, bias or hatred towards a particular group of which the victim is rarely significant to the offender and is most commonly a stranger to him or her. The current law (18 U.S.C. 245) permits federal prosecution of a hate crime only if the crime was motivated by bias based on race, religion, national origin, or color, and the assailant intended to prevent the victim from exercising a "federally protected right" (e.g. voting, attending school, etc.) T his dual requirement substantially limits the potential for federal assistance in investigating or prosecuting hate crimes, even when the crime is particularly heinous. à à à à à Hate crimes demand a priority response because of their special emotional and psychological impact on the victim and the victimsââ¬â¢ community. (1) According to the Australian Indigenous Psychologists Association (2010): ââ¬ËThe term cultural competency refers to a long-term, developmental process that moves beyond cultural awareness (the knowledge about Aboriginal and Torres Strait Islander people primarily gained through media resources and workshops) and cultural sensitivity (knowledge as well as some level of direct experience with Aboriginal and Torres Strait Islander people). Cultural competency emphasizes the idea of effectively operating in different cultural contexts: knowledge, sensitivity, and awareness programs o not include this concept. Cultural competence aims to reduce barriers to high quality care experienced by Indigenous people and is directly linked to improving social and emotional wellbeing and mental health outcomes. ââ¬â¢ Cultural Competence What is cultural competence? Cultural competence is the ability to interact effectively with people across different cultures. It has four components: * Awa reness of one's own cultural worldview (assumptions, biases) * A positive attitude towards cultural differences * Knowledge of different cultural practices and worldviews * Cross-cultural communication skillsWhat is cultural competence in health care? Culturally competent health care providers provide the best possible care for all their clients and work in the most productive way with all their colleagues. Everyone has a culture Cultural competence begins with the recognition that we are all born, raised and living in social, educational and organisational cultures. These cultures shape our assumptions, beliefs, values and behaviours. When we interact with others, the similarities and differences between our cultural expectations often make the interaction both more interesting, and more challenging. In a health setting, these challenges must be met if we are to provide equitable, appropriate and accessible services to all our clients. Competent practitioners are culturally competen t A person who is culturally competent can communicate sensitively and effectively with people who have different languages, cultures, religions, genders, ethnicities, disabilities, ages and sexualities. Culturally competent health staff strive to provide services that are consistent with the clientsââ¬â¢ needs and values firstly by acknowledging them, and secondly by, wherever possible, responding to them appropriately.Health care practitioners need to develop a broad repertoire of skills, knowledge, attitudes, perspectives and practices which they can use to enhance their cultural competence and direct their relationships with clients and colleagues. Cultural competence is about organisational competence It is very difficult to operate as a culturally competent practitioner without organisational support. SESIH is strongly committed to equality for clients and staff, and continues its commitment to the policies and principles of multicultural health. Benefits of a culturally co mpetent workforceLack of cultural competence impacts on both clients and staff. Clients who feel that their concerns have not been understood, who feel they have been dismissed or ignored, or who have not received optimum services because of their cultural background or ethnicity or language will find it hard to develop a sense of trust in a practitioner or a service. Culturally competent health staff build trust and respect which leads to increased client satisfaction and improved health outcomes such as a better use of the staff and clientsââ¬â¢ time, more accurate information, and more effective and acceptable outcomes for staff and clients.Cultural competence benefits everyone. Why is culture so important in health care? Because health care is cultural. Although the scientific bases for medical treatment and care is considered ââ¬Ëobjectiveââ¬â¢, the way that we choose and use health services, whether we accept a diagnosis, how we decide if we will continue with a parti cular medical treatment, and the sorts of questions we ask health staff are all culturally influenced. Staff need to recognise the beliefs and values that affect our health decisions and take account of them when treating us (2)

Plato theory of forms Essay
Plato was a duellist and thus believed that there are two worlds; the material world and the world of ideas/Forms. The world of ideas or Forms is the true reality and the world of appearances is just reflections of world of Forms. Plato believed that our knowledge of the Forms was a priori which means that our souls knew the Forms before it was inside us, therefore we have knowledge prior to experiencing the objects with our senses. Plato believes everyone is born with an intuitive but imperfect understanding of the Forms. He also believes the philosopher is able, through using his intellect, to achieve true knowledge of the abstract Forms without using his senses. Platoââ¬â¢s theory of Forms can be seen as unconvincing to some who believe that abstract ideas e. g table, horse, beauty are actually names that have been invented to help people describe their experiences of the physical world. This is a materialistic view as it suggests that objects in this world are the real reality and our ideas can develop based on experience of things. Aristotle agrees with this and believes knowledge is gained through experience and that there is not an eternal World of Forms that is a priori to us. However, in Platoââ¬â¢s defence some believe that each variety of a Form shares a likeness for example each horse is slightly different yet they all share something that makes it resemble a horse. According to Bertrand Russell, Plato`s theory made a `very important advance in philosophy, since it is the first to emphasise the problem of universalsââ¬â¢. Platoââ¬â¢s theory is often regarded as unconvincing due to the fact that Plato believes that every object and idea in the world of appearances is an imperfect copy of an image or Form in the World of Forms. This suggests that there is a perfect Form of things such as a cinema ticket, mud or an insect and so on. According to Bertrand Russell, his ideas of the Forms when taken to its extreme.

The opinions expressed herein are subject to change without notice. WHAT you NEED TO KNOW Adopting a single-instance, single-vendor enterprise resource planning strategy can deliver benefits, but it does not make sense for every organization. It should only be undertaken If you have a good business case for the project and it matches most or all of Garter's single-instance success factors. If the challenges balance or outweigh the success factors, then you should address organizational issues before proceeding. If this Is not feasible, then consider Illimitableness consolidation or a tiered business application strategy. ANALYSIS Most large multinational organizations have a heterogeneous application portfolio hat has built up over time. The portfolio often is made more complex by tactical purchasing and merger and acquisition activity.Senior executives in such organizations are attracted to the idea of standardizing on applications from a single enterprise resource planning (ERP) vendor because of potential operational cost savings and reduced complexity of the IT landscape (see Note 1). Vendor consolidation is often a first step toward instance consolidation. ; A single instance of an application can run all operating companies on a common process template, a ingle release AT ten application Ana a giggle copy AT ten applications dataset, using a cons olidated technical infrastructure.A single-instance strategy can drive cost reductions in several areas, including integration, interfaces, training, support and hardware. In addition, potential benefits may be found in process improvements, better data consistency and improved visibility of information. However, adopting a single-instance, single-vendor ERP strategy is not a task to be undertaken lightly, because it can create disruption in enterprise operations and often involves replacing some systems that are favored by users.Even if the business case appears to support the deployment of a single-instance ERP solution, there still may be significant obstacles to overcome. Certain types of organizations will find it more difficult to realize the benefits of a single-instance ERP strategy because of their culture and infrastructure. See Table 1 to determine whether single-system ERP might work for your organization. Rank yourself against each of the categories. If you have mainly (or exclusively) success factors, then a single-instance ERP strategy is more likely to be successful. Table 1 .Single-Instance ERP Success Factors and Challenges Enterprise Profile Business Model Corporate Culture and Policy Definition Geographical Concentration Success Factors Single primary core business with similar business processes Centralized with strong corporate head office; policy dictated at corporate level and globally enforced Company aspires to operate as a single global company, and operations, sales and marketing are concentrated in a single geographical region Stable, unlikely to undergo dramatic growth or downsizing Challenges Diversified group with wide range of business processes Decentralized tit autonomous business units; policy decided at the business-unit level Company operates as a multinational company, and operations, sales and marketing are distributed globally Dynamic, growing rapidly or downsizing significantly Business Environment publication Date: 28 September 2005/AD Number: GO 30366 2005 Garner, Inc. Single-instance strategies are typically noninsured first in the ERP domain because these processes are more internally focused and homogeneous, and have less impact on competitive differentiation. Suitability of a single-instance strategy in other domains, such as customer relationship management (CRM), product life cycle management (PLUM) and supply chain management (SCM), should be assessed following a similar process. However, with CRM, PLUM and SCM, organizations are even less likely to meet the criteria in Table 1 and will typically discover that a single-instance strategy doesn't align with the business strategy.By implication, even if a single-instance ERP environment is successfully created, most organizations will have to support multiple instances of peripheral systems. Enterprise Profile Elements ; Business Model: Organizations in service industries such as software or financial services will find adoption of single- system ERP easier than those with a diversified business model, because the ERP adoption will primarily affect their back-office administrative functions. Process changes in these areas will have less impact on revenue-creating activities and, therefore, are lower risk than changes in operational areas such as manufacturing and logistics operations.Corporate Culture and Policy Definition: Organizations that operate in a decentralized manner with highly autonomous business units may find these operations unwilling to release control of local systems to a central IT function. If there is a culture of local decision making, then business-unit executives may not be willing to accept a decision that is mandated from the corporate head office. Geographical Concentration: Companies that aspire to operate as global companies (operate on a common set of business processes across the globe) are well- positioned to achieve a global single instance, because they align the IT strategy with he business strategy.Companies operating as multinationals (have a unique set of business processes for local markets, particularly sales and marketing, and SC M), will have difficulties running their international businesses on a common system. Also, organizations that are physically concentrated in a single geographical region will find it easier to achieve a single instance, because support and operations of the system take place in a narrow range of adjacent time zones. The need to support a single instance around the clock creates issues with available support windows for upgrades and maintenance, and possibly network-related performance and availability issues.Business Environment: A single-instance ERP strategy may not be appropriate for organizations that face significant change. Implementation of a single-instance system may be thrown into disarray if there is a significant change of direction in the business Page 3 of 6 (for example, a manufacturer decides to sell its manufacturing operations and focus instead on design and logistics services). ; Merger, Acquisition and Divestiture Status: This aspect of the general business situ ation can have a major impact on a single- instance strategy. Organizations that are likely to acquire or merge with entities of a similar size may find their investment in a significance strategy compromised if they merge with organizations that use different ERP systems.Established ERP Systems: If the ERP system from a potential single-instance vendor is already used in the majority of the organization, then there may be little resistance to a wider deployment. Many organizations have initially implemented multiple instances of a single ERP system are now considering instance consolidation. However, if there is no nominate provider, then a single-instance strategy will face resistance, because some users are likely to fight to retain their ââ¬Å"much lovedâ⬠locally implemented systems from ââ¬Å"theirâ⬠vendors. Technology Environment: Similar challenges may arise if there is no common technology environment and enterprise architecture in place.A single- instance stra tegy requires the adoption of a specific technology environment (operating system, database, middleware and other IT infrastructure), and organizations that already have an enterprise architecture in place will find it easier to implement a single-instance approach. When the technology environment is defined at the business-unit level, local IT functions may resist moving away from their architecture to that which is required to support the single-instance strategy. Determining Who Drives the Initiative Often, instance consolidation initiatives are driven by the IT organization on the basis of simplification of the application landscape, and the IT technical and support infrastructure. Table 1 shows that five out of the seven success factors are within the business domain and entirely outside the control of the IT organization. This underscores the point that instance installation projects should primarily be business-driven projects, with a business case solidly based on business be nefits. Without understanding, sponsorship and commitment at the senior business management level, the project is doomed to fail. The IT organization plays a critical role in educating the business units, and planning and executing the project; however, it does not own the project. What to Do If the generalness outlawed ten success Factors organizations considering giggle-alliance ERP that find the challenges outweigh the success factors have other options: 1 . Consider a limited ERP vendor and infrastructure consolidation strategy, without moving to a single-instance consolidation. This strategy will enable organizations to achieve some efficiency improvements in the IT organization by consolidating some of the operating and support infrastructure of the ERP systems. However, the strategy will not realize the full benefits of a single-instance system. This strategy may be suitable for organizations that are diversified and decentralized in nature, operate in a highly dynamic market environment and consider IT costs to be a significant factor. A common approach is to adopt vendor consolidation with some level of instance consolidation (for example, regional or divisional instances). 2. Adopt a tiered business application strategy (see ââ¬Å"How to Approach Tiered Business Applicationsâ⬠), where specific applications are adopted to address the needs of decentralized business units.Page 4 of 6 3. Address the organizational issues that are creating the challenges prior to implementing the single-instance strategy. There are two main actions that need to be taken to address these organizational issues: ; Involve business-unit executives in alluding and reviewing the business case to create buy-in. Develop a feasibility study that shows how business-unit requirements can be accommodated in a single- instance implementation, and build an instance strategy to support this. Consider getting business-unit executives to develop a business case to Justify why their business unit should not be included in a single-instance solution.Get the executive management team to understand and accept how investing in a single-instance strategy can affect your merger and acquisition strategy. During their due diligence, organizations adopting a single-instance strategy must take account of how ERP systems are used by potential acquisition targets. Similarly, a single-instance strategy may limit downsizing options, because it will be difficult to divest parts of the business on an ongoing basis if they do not have their own business applications. If significant divestiture is likely, then a single-instance ERP project should be deferred until the business environment stabilizes. Key Issues How can more value be gained from an enterprise resource planning investment?Note 1 Definition of Single Instance A single instance of an ERP system is when a single installation of the application is linked to a single database. This significantly sleepless support Ana m alfeasance Decease tenure Is only one set AT application infrastructure to be maintained. This does not necessarily mean that all business units have to use the same business rules, because most ERP systems enable different entities within a single instance to have a degree of uniqueness. However, there will be constraints on the capability of the business units to define their own business rules (compared to separate instances for each business unit).

Movie Analysis Essay
There are many versions of Spiderman, but ââ¬Å"Amazing Spider-manâ⬠is the best version ever. The graphic works, the music, and the plot are amazing like the movie title. The Amazing spider-man is not connected to the previous Spiderman movie. One online film critic stated that there is a silent war ongoing right now between two of the big comic book flicks hit theaters in July of 2012: Warner Bros. ââ¬â¢ The Dark knight Rises and Sonyââ¬â¢s The Amazing Spider-Man (Sandy Schaefer). In addition, I do believe that this movie really sound like a more genuinely contemporary portrayal of the eponymous webslinger than that offered in Raimiââ¬â¢s previous movie trilogy. Although some of the character I do not like the way they act and somehow they cannot give me a clear mind what they should able to act, I could still agree this version of the Spiderman is the best I have seen. The characters in the movie are very rich for the audience to watch. Every action movie are essential to have the element of love scene, fighting scene, the falling scene, and the return scene. The main character is obviously the Spider-man Peter Parker. Here is the aforementioned from Amazing Spider-Man: ââ¬Å"Like most teenagers his age, Peter [played by Andrew Garfield] is trying to figure out who he is and how to be the person he is today. In his journey to put the pieces of his past together he uncovers a secret that his father [Campbell Scott] heldâ⬠¦ a secret that will ultimately shape his destiny as Spider-Man. This is the first in a series of movies that tells a different side of the Peter Parker story. â⬠(Schaefer). Peter Parker has struggled to find his purpose in life, ever since Peterââ¬â¢s parents disappeared 13 years old. Like other movies, he must face the ultimate challenge on the brink of unlocking the mystery. Thus, he is absolutely hero archetype that he defeats Dr. Connors and safe the whole New York City. The female character, Spider-man girlfriend, Gwen Stacy is knowledgeable and wise. For some moment, she is charismatic and rebellious when she deal with her family. Gwen is the chief intern at Oscorp, a position she takes very seriously. However, her mentor Dr. Connors is the competitor of Spiderman. Captain Stacy is an esteemed police officer who leads the investigation into Spiderman. Captain Stacy is highly alert to his family more than the city, especially his only daughter, Gwen. Apparently, the villain is Dr. Connors. It is not clear that he is the lizard when it comes to the end. He is a scientist that attempts to engineer a revolutionary regeneration serum to help regrow limbs and human tissue. He became so horrible at the end. The heroââ¬â¢s journey is always followed by the 17 stages of Joseph Cambellââ¬â¢s Monomyth. But for nowadays movies, they eliminate some of the stages in a simply form. Not surprisingly, Campbellââ¬â¢s idea is generally applied to many Hollywood screenwriting and literature as well. The Ordinary World- Peter Parker is a student at Midtown Science High School, and he lives with his Uncle Ben and Aunt May. His parent is a mystery and left him with no explanation when he was young. As a result, Peter is frustrated and longs to find out more about his father and why he left. Peter is weird around his peers, but he still sticks up for the underdog. Call to Adventure- Peter found out a file and lead him to research his fatherââ¬â¢s lab partner who works at Oscorp Tower, Dr. Connors. He goes to him and look out for answers. Later, he is bitten by a spider that is being used to create biocable. He starts to have the abilities of spider. He has been introduced to the Special World that is opposite of what he knows. Refusal of the Call- Peter begins to test his power, and using them to beat the bully who picked on him, Flash Thompson. His emotion change and have argument with Uncle Ben. Because Uncle Ben feels his strange behavior, so he follows him and that make the tragedy of the thief shoots Uncle Ben. Meeting with the Mentor- Dr. Connors is a mentor to him when it comes to science. Another crucial mentor is Uncle Ben of course. Hence, he gives a big influence on Peter, and when he dies, Peter is pushed to his limits. Crossing the Threshold- Because of the death of Uncle Ben, Peter pushed himself into the Special World. Peter tries to hunt the thief who murdered Uncle Ben. Test, Allies, Enemies- When Peter fights crime, he confronts criminals and makes enemies. At school, he developed a friendship with Gwen. His tests are increasing in difficulty: Dr. Connors displayed a semblance of friendship toward him, but as his identity shifts into the Lizard, this will change. Captain Stacy, Gwenââ¬â¢s father, shows an antagonistic attitude toward Peter and his alter-ego. Approach- Spiderman tries to stop the creature on the bridge. The Lizard got a big fight at Midtown Science high School, and Peter tries to stop him with Gwenââ¬â¢s help. Ordeal- Spiderman was shot by a police bullet that stuns him electrically. It is a hard time to Spiderman to fight his way out, reveals his identity to Captain Stacy. Reward- Captain Stacy lets him go, showing his trust in Peter. Resurrection- The Lizard is strong and powerful. Captain Stacy and Peter Parker finally work together to restrict the activities and take the Lizard down. Return with the Elixir- Dr. Connors has been returned back to normal. He has saved Gwen, but Captain Stacy was killed. As he dies, he asks Peter to keep Gwen out of his life to protect her. It is not only a promise to Captain Stacy, but also in a carton of eggs. He is a different person, and even though he may not have all of the answers he wanted, he has learned to put others ahead of himself during the search. The Elixir Peter Parker has brought back from his journey is that of a new hero. He is no longer just Peter Parker, fatherless teenager. He is Spider-Man. (Milles). Peter Andrew Garfield who is the actor of Spiderman did a good job in the movie because it is a challenge to an actor to have a big different from being a normal person to an amazing ultimate hero. Andrew Garfield can express and show on his face that the inner features of Spiderman to the audience. Honestly, the only person I do not satisfy is Emma Stone, who is the actress of Gwen Stacy, and I reckon many of the commends on the internet board criticize that she has not done a great job on her part. For instance, there is a frightening scene that she is holding a knife hiding when Dr. Connors has become the Lizard and chasing her. I am sorry to say that, but I cannot feel any scary moment in the scene. For the love scene, I do not think she acts like a spouse of Peter Parker. Also, she did not have the interaction with her family show that she is rebellious. The plot is moving smooth and clear when I follow along to the heroââ¬â¢s journey. Refer to the heroââ¬â¢s journey, the plot is developed and excited. I would not find any boring scene in the entire movie. When I watched along with it, I would have many unexpected things happen, and really influence the audience to keep watching on it. Moreover, the music composer of the movie is James Horner. Indeed, he is a great composer of film music. James Horner also composes some great movies such as Titanic and Avatar. He is currently as famous as John Williams and the music they composed does make the audience impressed. His music moved the audience, and there is no doubt that film music is so significant because we are not only watching the screen, but listen to the music also. Amazing Spiderman is well-developed movie as following the classic heroââ¬â¢s journey. It does make the audience easy to follow and a feeling of unexpected. Also, the action scene is exciting to watch. Even though I know it is not real, but I really get into it. Furthermore, the music do influence the audience and no movie can neglect music because it is an crucial tools.

Alcoholism diseases for mankinds Essay Example | Topics and Well Written Essays - 750 words
Alcoholism diseases for mankinds - Essay Example ic, and environmental factors that influences its advancement and manifestation and it is associated with many possible causes and numerous detrimental effects on the alcoholic. Some of the alcoholism diseases of mankind are liver cirrhosis, schizophrenia, and hepatitis C infection. According to MedicineNet (2014), liver cirrhosis is one of the most severe forms of alcoholic related liver diseases especially amongst people drinking excessively. The disease normally see the healthy cells of the liver tissue replaced by scar tissue in the process known as fibrosis thus making the liver tissue to become lumpy and hard instead of smooth. Some of the early symptoms of alcohol induced cirrhosis include loss of appetite, feeling sick and vomiting, itchy skin, and weight loss. However, when the conditions progresses the symptoms may include yellowing of skin, swelling in the abdomen, muscle wasting, bruising and bleeding easily, confused feeling, or having poor memory and sexual changes. It is worth noting that liver always has significant function of processing alcohol one drinks. Conversely, it can only handle a specific amount of alcohol and therefore heavy or regular drinking puts strain and eventually damages the liver. The damage on the liver makes it less able to perform the function of processing chemical substances, which is a risky because the gradual damage on the liver may finally make it stop working properly (MedicineNet, 2014). Many alcoholics have ended up dying because of inappropriate medication or fatal cases of alcohol induced liver cirrhosis. The damage caused on the liver is irreversible although further damage may be stopped if individuals stop drinking. There a number of heavy drinkers who have undergone liver transplant because of their damaged livers. Additionally, the second disease caused by alcoholism is schizophrenia mostly because alcohol is highly abused apart from nicotine. People suffering from schizophrenia consume alcohol for same

A Strategic Communication Campaign on Coca Cola Company 2012 Essay - 20
A Strategic Communication Campaign on Coca Cola Company 2012 - Essay Example The Coca cola Company is the worldââ¬â¢s largest multinational beverage producer, distributor and retailer in non alcoholic drinks. It is the legal owner of syrup concentrate that is used for the production of over 500 drinks notwithstandingà à the ownership of anchor bottler; the Coca ââ¬â cola Refreshments. Being the worldââ¬â¢s most valued brand, the Companyââ¬â¢s mission is to ensure that the world is refreshed, inspired towards moments of optimism and happiness, andà making intention onà creatingà more value and making a difference. As such, the Company vision entails making frameworks that guide their business towards sustainable growth. Thus, the company has ensured that their products come in varying shapes, sizes in reference to price tags (Thompson Para 2). In 2012, the Coca cola Company launched a Public Relations (PR) campaign that was aimed at making soda personal in New York City. The aggressive campaign emphasized on the fact that the accessibility and consumption of large soda was meant to be an issue pertaining to personal freedom. Additionally, the campaign argued that the legislation that had at the time banned the use of large sodas for individuals was only aimed at infringing the right to purchase the much in terms of quantity an individual would afford to buy, as well as, consume (Downs, 4) Essentially, the campaign was organized in response to claims that had been put forward by Mayor Bloomberg. In his argument, Bloomberg noted that the Coca cola Company was producing large quantitiesââ¬â¢ of sodas that posed numerous health risks to consumers and compelled them to use more money on sodas rather than spending the money on other important issues (Thompson Para 2). In this regard, the Coca cola Company reacted to the issue through the creation of a new group known as ââ¬ËNew Yorkers For Beverage Choicesââ¬â¢. The main function was to ensure that they would plead with most people who used the internet against giving consent to Mayor Bloomberg who was determined to ban drinks that exceeded 16 ounces (Thompson Para 3). As a matter of fact, the target audiences in this strategic campaign are potential consumers and potential competitors.
